Abstract

Purpose

The purpose of this paper is to show how data mining techniques can improve the performance management of the judiciary, helping judges in steering position with specific and timely measures. It explores different approaches to analyse the length of trials, based on the case of an Italian judicial office.

Design/methodology/approach

The paper presents a temporal analysis to compare the timeliness of trials, using data and process mining approaches with the support of a specific software to represent graphically the results. Data were gathered directly from the office data base, improving precision and the opportunity to monitor specific phases of the trials.

Findings

The results highlight the progress that can be reached using data mining approaches to develop performance analyses helping courts to correct inefficiencies and to manage the personnel distribution, overcoming the critical comments arisen against traditional KPI (Raine, 2000). The work proposes a methodology to analyse cases deriving from different juridical matters useful to set up a performance monitoring system that could be diffused to different courts.

Research limitations/implications

The limitations of the research regard the analysis of a selected, limited number of cases in terms of judicial matters.

Practical implications

Data mining techniques can improve the performance management processes in providing more accurate feedback to the judicial offices leaders and increasing the organisational learning.

Social implications

The performance of the judiciary is one of the relevant issues that emerged in the recent decade in the field of public sector reforms. Several reasons explain this interest, which has gone beyond the specific legal disciplines to involve public policy, management, economics and ICT studies.

Originality/value

Considering the literature on the judiciary (Visser et al., 2019; Di Martino et al., 2021; Troisi and Alfano, 2023) the contribution differs as both the methodological approach and the predictive analysis considers the intrinsic differences that define cases belonging to different juridical matters performing a cross-sectional analysis, with a specific focus of process variants.

Abstract

Purpose

In 2009, the Italian Government initiated a national programme to improve the management of judicial offices. Programme implementation has been patchy and unsatisfactory in all but a few cases. Against this background, the Law Court of Milan has achieved exceptional results and is now recognised as a good practice benchmark for Italy. The purpose of this paper is to investigate this case in order to reconstruct the local conditions for successful implementation of the national programme.

Design/methodology/approach

To test a theory of the programme based on leaders’ engagement, their access to managerial knowledge, and the transfer and consolidation of that knowledge, the present study applies process tracing, a qualitative method that uses Bayesian reasoning to improve the accuracy of within-case inferences.

Findings

The analysis shows how programme and context features interacted to support change. In particular, while the national programme succeeded in providing resources for leader engagement and knowledge access, the transfer and consolidation of managerial knowledge depended largely on a brokerage function performed locally between consultants and magistrates.

Originality/value

The paper sheds light on the local conditions for change management and does so by employing an innovative qualitative method that improves the reliability of within-case inferences.

Abstract

Purpose

The purpose of this paper is to compare the different performance-based budgeting models used in the judiciaries of three European countries: Italy, Finland and the Netherlands. In particular, this paper focusses on the criteria adopted by these three countries to fund the courts, and it analyses the effects of these criteria on the distribution of resources and performance variability among first instance courts.

Design/methodology/approach

This exploratory research is based on a literature review and data analysis of three case studies. Equity in resource distribution and equality in courts' performance are assessed using the coefficient of variation.

Findings

The preliminary findings suggest the following: (1) funding models with a close link between performance and budget better guarantee equitable allocation of resources among courts and, therefore, more equal performance among courts within a country; (2) unbalanced allocation of resources is associated with disparities among courts in terms of judicial efficiency and effectiveness and consequently, unequal treatment of/outcomes for citizens coming before the law.

Research limitations/implications

This paper is part of a broader research project aimed at analysing the impact of performance budgeting on the efficiency, quality, organization and values of judiciaries. This study only considers quantitative aspects of performance, but it will be followed by further analysis that will explore performance and judicial budgeting from other perspectives.

Practical implications

This paper describes examples of three different models of performance-based judicial budgeting from other countries, which aim to reform the budgeting processes of the judiciaries in question. The paper emphasizes the importance of adopting rational and transparent funding criteria in order to ensure judicial independence and accountability and to balance courts' performance, guaranteeing the principle that every citizen must obtain the same treatment before the law.

Originality/value

This paper contributes to the existing performance-based budgeting literature by studying its application to the judiciary, which, due to its peculiarities, is an area that has been overlooked in previous studies and deserves further attention. This study contributes to the court administration literature by exploring the issue of budgeting, which, despite its importance, is still a neglected subject.

Abstract

Purpose

The purpose of this paper is to present a study of the effect of different types of annealing schedules for a ribonucleic acid (RNA) secondary structure prediction algorithm based on simulated annealing (SA).

Design/methodology/approach

An RNA folding algorithm was implemented that assembles the final structure from potential substructures (helixes). Structures are encoded as a permutation of helixes. An SA searches this space of permutations. Parameters and annealing schedules were studied and fine-tuned to optimize algorithm performance.

Findings

In comparing with mfold, the SA algorithm shows comparable results (in terms of F-measure) even with a less sophisticated thermodynamic model. In terms of average specificity, the SA algorithm has provided surpassing results.

Research limitations/implications

Most of the underlying thermodynamic models are too simplistic and incomplete to accurately model the free energy for larger structures. This is the largest limitation of free energy-based RNA folding algorithms in general.

Practical implications

The algorithm offers a different approach that can be used in practice to fold RNA sequences quickly.

Originality/value

The algorithm is one of only two SA-based RNA folding algorithms. The authors use a very different encoding, based on permutation of candidate helixes. The in depth study of annealing schedules and other parameters makes the algorithm a strong contender. Another benefit is that new thermodynamic models can be incorporated with relative ease (which is not the case for algorithms based on dynamic programming).

Abstract

Purpose

The authors consider the problem of optimizing temporary fastener patterns in aircraft assembly. Minimizing the number of fasteners while maintaining final product quality is one of the key enablers for intensifying production in the aerospace industry. The purpose of this study is to formulate the fastener pattern optimization problem and compare different solving approaches on both test benchmarks and rear wing-to-fuselage assembly of an Airbus A350-900.

Design/methodology/approach

The first considered algorithm is based on a local exhaustive search. It is proved to be efficient and reliable but requires much computational effort. Secondly, the Mesh Adaptive Direct Search (MADS) implemented in NOMAD software (Nonlinear Optimization by Mesh Adaptive Direct Search) is used to apply the powerful mathematical machinery of surrogate modeling and associated optimization strategy. In addition, another popular optimization algorithm called simulated annealing (SA) was implemented. Since a single fastener pattern must be used for the entire aircraft series, cross-validation of obtained results was applied. The available measured initial gaps from 340 different aircraft of the A350-900 series were used.

Findings

The results indicated that SA cannot be applicable as its random character does not provide repeatable results and requires tens of runs for any optimization analysis. Both local variations (LV) method and MADS have proved to be appropriate as they improved the existing fastener pattern for all available gaps. The modification of the MADS' search step was performed to exploit all the information the authors have about the problem.

Originality/value

The paper presents deterministic and probabilistic optimization problem formulations and considers three different approaches for their solution. The existing fastener pattern was improved.
